Although one live cartridge is said to have been recovered from conscious possession of the petitioner but according to the prosecution case itself, one country made rifle, five empty cartridges and six live cartridges were recovered from the house of the petitioner. The contention on behalf of the petitioner is that recovery of rifle and above stated cartridges have been made from joint house and not from conscious possession of the petitioner and so far as criminal antecedent of petitioner is concerned, only one case that is, too, was lodged against the petitioner in the year 2003 and after that except the present one, no case has been lodged against the petitioner.
