JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-03-2023 Though, the present writ petition has been filed for removal of encroachment from Plot No. 439, Khata No. 424 situated at village Jagapakar under Harsidhi-Block, District-East Champaran, which is alleged to be a public road but it has been pointed out that an encroachment case bearing Encroachment Case No. 01 of 2016-17 has already been initiated by the Circle Officer, Harsidhi, however, the same has not been taken to its logical conclusion till date, hence it be directed that the said encroachment case be disposed off,
Patna High Court CWJC No.2439 of 2017(4) dt.15-03-2023 2/2 forthwith.
Having regard to the limited prayer made by the learned counsel for the petitioner, I deem it fit and proper to dispose off the present writ petition with a direction to the Circle Officer, Harsidhi to dispose off the aforesaid Encroachment Case No. 01 of 2016-17, in case the same has not already been disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order.
