Petitioner is languishing in jail custody since 27-09-2015 in a case registered under Sections-419, 420, 411 of the Indian Penal Code and Section-66(D) of the I.T. Act on the accusation that when the informant went to withdraw money from ATM, the petitioner diverted the attention of informant and withdrew Rs. 10,000/- from the account of the informant.

The petitioner does not have any criminal antecedent and submission on behalf of the petitioner is that a hot exchange of words had taken place between the petitioner and the informant on a petty issue but the informant, with the help of his supporters,

Patna High Court Cr.Misc. No.1653 of 2016 (2) dt.21-01-2016 2/2 caught the petitioner and lodged this false case. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bibhutipur P.S. Case No. 195 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera at Samastipur.
