Learned counsel for the petitioner undertakes to remove the defects, if any, within three weeks. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 341, 307, 379, 504, 506/34 of the Indian Penal Code. Petitioner is said to have assaulted the informant by means of iron rod as a result of which he received injury. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that there is specific allegation against the co-accused. He further submits that petitioner has criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.33956 of 2022(3) dt.23-01-2023 2/2 Learned APP for the State opposes the prayer for bail and submits that the petitioner armed with iron rod like khanti assaulted the informant due to which the informant sustained grievous injury on his head.

Considering the nature of injury, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Matihani P.S. Case No. 22 of 2022.
