During course of exercising of fishery right, both groups locked their horns and during course thereof, at the instigation of Kaushal Mahto others have had assaulted with lathi while Pintu Mahto fired from rifle causing injury over Maheshwar Paswan, Sanjeet Paswan and others. Admittedly petitioners are not at all assailant by means of firearm and only to the extent of injuries caused by firearm, opinion has been reserved. Petitioners are under custody since 02.01.2015 as well as 11.11.2015 respectively.

Accordingly, petitioners Rajesh Kumar, Sato Mahton each are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the

Patna High Court Cr.Misc. No.17151 of 2015 (2) dt.01-05-2015 like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kashichak P.S. Case No.01 of 2015.
