The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the informant who claims to be the care taker of apartment namely White House has alleged that this petitioner being owner of one of the flats had attacked with other

No.34183 of 2023(2) dt.03-07-2023 2/3 accused persons and assaulted on his chest and abdomen by a sharp weapon as a result of which the thumb got severed and heavy blood began to ooze. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is no accusation of repeating the blow. The injury received by the informant is not on vital part of the body and the injury has been found to be simple in nature. The wife of the petitioner has also lodged Kotwali P.S. Case No. 209 of 2023 against the informant and others. The petitioner is languishing in custody since 20.03.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
