JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 22.08.2014 in a case registered for the offences punishable under Sections 366A and 504/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

In 164 Cr. P.C. statement, the victim got her age recorded as 16 years when the learned court below also assessed as such where she stated that she was being abducted by Sunil Kumar and Chandan Kumar and subsequently above named two persons along with Arbind established forceful physical relationship with her but ultimately the three accused persons contacted this petitioner to reach home the victim. It is submitted by learned counsel for the petitioner that from 164 Cr. P.C. statement of the victim it appears that the either

Patna High Court Cr.Misc. No.7478 of 2015 (2) dt.02-03-2015 2/2 accusation of kidnapping or establishment of forceful physical relationship is not levelled against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Aurangabad in connection with Goh P.S.
