ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.10.2015 in connection with Sirdala P.S. Case No.206 of 2015 registered for the offences under Sections 341, 324, 326, 307 and 504 of the Indian Penal Code and Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.

Learned counsel for the petitioner submits that if at all the allegation is to be believed, the injury purported to have been inflicted by the petitioner is found to be simple in nature. Considering the fact that there was no premeditation and that the occurrence had taken place on the spur of the moment and also that the petitioner has no criminal antecedents,

Patna High Court Cr.Misc. No.3853 of 2016 (2) dt.09-02-2016 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Nawada, in connection with Sirdala P.S. Case No.206 of 2015.
