The matter has been taken up through video conferencing.
The petitioner seeks bail in Patliputra P.S. case No. 83/2020 registered u/s 20/22 of the NDPS Act and u/s 30(a) of the Bihar Prohibition & Excise Act.
500 gram Ganja and six liters of country made liquor are said to have been recovered from the tobacco shop of the petitioner and for that the petitioner is in jail since 17.08.2020. The learned counsel for the petitioner submits that small quantity of Ganja is recovered from the shop of the petitioner for which maximum punishment is six months. The
Patna High Court CR. MISC. No.32373 of 2020(2) dt.07-12-2020 2/2 petitioner has already remained in jail for about four months. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Patliputra P.S. case No.83/2020.
