2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Aurangabad Town P.S. Case No. 113 of 2026, G.R. No. 436 of 2026 instituted for the offence under Sections 331(4) and 305 of the B.N.S. and later on Sections 317(5) and 3(5) of the B.N.S. have been added.
3. The case of the prosecution, in short, is that some unknown miscreants have committed theft in the house of the informant.
2. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.35801 of 2026(2) dt.24-07-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that the name of this petitioner has surfaced in the confessional statement of co-accused Dev Verma. Save and except for the confessional statement of coaccused, there is nothing against the petitioner. No recovery has been made from the possession of this petitioner. He further submits that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Similarly situated other co-accused person has already been granted bail by this Court vide Cr. Misc. No. 31630 of 2026.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below and in the event of his arrest or surrender in connection with Aurangabad Town P.S. Case No. 113 of 2026, G.R. No. 436 of 2026, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad
