Petitioner is not named in the first information report and it appears that the name of petitioner came in course of investigation. The learned court below has referred only para-19 of the case diary to show the involvement of the petitioner in the alleged crime but the learned court below did not take pain to state what has come in para-19 of the case diary. Moreover, learned counsel for the petitioner appearing for the petitioner points out that on the basis of information given by the Spy of the police, petitioner has been dragged in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,
