Petitioner seeks bail in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

The daughter of the informant was found missing from her house. On the basis of Mobile No. of two person saved in the mobile of the daughter, suspicion was raised against holder of those mobile. After recovery, statement of the victim was recorded under Section 164 Cr.P.C wherein she had stated that she was kidnapped by unknown person and the police alongwith parents came to the place where she was in captivity she saw that police had arrested this petitioner. Petitioner was known to her as both were studying in the same school.

No.33036 of 2019(5) dt.30-09-2019 2/2 The learned A.P.P., who has received the case diary when the matter was listed before another Bench, is not present here and the Office is directed to ensure that the case diary is received from him and transmitted back to the court concerned.

Since the victim has not alleged anything against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Town Police Station Case No.03 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
