The petitioner seeks bail in Hajipur Town P.S. Case No. 611 of 2014, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner is said to have confessed his guilt and disclosed that his mobile was used by the accused persons who kidnapped the victim. The learned Sessions Judge has referred para-73 of the case diary in which it is stated that the petitioner is the owner of mobile no. 9798433549.

It is contended that the same SIM number does not belong to the petitioner and from the consumer application form of

Patna High Court Cr.Misc. No.6423 of 2015 (5) dt.13-05-2015 2/2 mobile no. 9798433549 it appears that owner of the aforesaid mobile number is Ravi Shankar Kumar not the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 611 of 2014.
