JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Nawada Town P.S. Case No. 445 of 2015 registered under Sections 341, 323, 504 and 354B/34 of the Indian Penal Code and Section of the POSCO Act.

The accusation of informant Mulush Devi is that on 03.07.2015 at about 8.30 P.M., she along with her daughter Amisha Kumari, was returning to her house after purchasing the household articles and in the way, when she reached near the house of petitioner Sonu Pandey, he started to abuse her daughter. Thereafter the petitioner caught hold of her daughter Amisha Kumari and took her to his house, where she was also caught hold

Thereafter, she called villagers and then villagers reached there in spite of that, they did not open the door. Thereafter, the Police reached there and recovered his daughter while the petitioner succeeded to flee away jumping from the roof.

Learned counsel for the petitioner submits that the petitioner and the informant are next door neighbour and has falsely been implicated in this case due to dispute of the lane. Learned counsel for the petitioner further submits that the informant has stated about recovery of her daughter by the Police but witnesses have stated about permitting the victim to move from the house from back side before arrival of Police. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 445 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Vats/- U T
