"This writ application is directed for issuance of an appropriate writ in the nature of certiorari for quashing the impugned order of dismissal from service issued vide Memo No. 908 dated 19.05.2021 (contained in Annexure 9) issued under the signature of Respondent No. 3."

Petitioner has been dismissed from service on 09.02.2021 pursuant to the enquiry conducted against the petitioner. Petitioner has a statutory remedy of appeal before the

Patna High Court CWJC No.13595 of 2021 dt.01-12-2021 2/2 appellate authority and has invoked the remedy of appeal before the appellate authority and it is pending consideration as is evident from the pleadings.

In the light of these facts and circumstances, the appellate authority is hereby directed to examine the petitioner's memorandum of appeal and proceed to pass a speaking order after due consideration of each of the contentions raised in memorandum of appeal.

The above exercise shall be completed within a period of four months from the date of receipt of this order. With the above observations, writ petition stands disposed of.
