03-03-2015 Heard learned counsel for the petitioner and Sri Nagendra Prasad, learned Addl. Public Prosecutor. The petitioner, who is in custody since 26.08.2014 in Mohaniya P.S. Case No.266 of 2014 registered for the offence under Sections 25(1-B)A/26 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner was falsely implicated in the present case at the instance of his Pattidar and nothing was recovered from him. However, it was shown that one loaded country-made pistol was recovered from the petitioner. It has been argued that the petitioner is in custody since the date of his arrest.
