The petitioner seeks bail in a case registered under Sections 324/307 of the Indian Penal Code.

It is submitted on behalf of the petitioner that altercation took place due to some dispute between two full brothers and petitioner is stated to have given blow by sharp cutting weapon. I have perused the report of the In-charge court which is kept at Flag A in which it is stated that only one witness was examined in part till 06.01.2015 and from 07.08.2014 the office of the concerned court is vacant. Petitioner is stated to be in custody since 02.11.2013 i.e., about 1 year and 4 months and there is no progress in the trial.

Patna High Court Cr.Misc. No.50569 of 2014 (4) dt.04-03-2015 2 / 2 Having regards to the facts and the circumstances of the case and in view of the fact that allegation upon the petitioner is giving repeated blow upon the informant causing several grievous injuries, this Court would not be inclined to grant bail. Accordingly, this application stands rejected. However, the trial court is directed to conclude the trial expeditiously preferably within six months. If the trial is not concluded within the aforesaid period then the petitioner, if so advised, would be at liberty to renew his prayer for bail. (Dr. Ravi Ranjan, J) Sanjay-II/- U T
