03-03-2015 Heard Sri Rajendra Narain, learned Senior Counsel, who was assisted by Sri Udai Shankar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 05.09.2014 in Bhagwan Bazar P.S. Case no.143 of 2014 ( G.R. No.4401 of 2014) registered for the offence under Sections 222, 223, 224, 225 and 120(B) of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that along with the petitioner, constables and drivers were also made accused for connivance and allowing the petitioner to abstain from judicial custody, while he was being treated in Sadar Hospital, Chapra. It has been argued that other co-accused persons, namely, Bindeshwary Yadav, Rajeev Ranjan Tiwary and

Patna High Court Cr.Misc. No.49343 of 2014 (3) dt.03-03-2015 2/2 Krishna Kumar Sharma have already been granted bail by the learned court below itself. Learned counsel for the petitioner accepts that the petitioner is still in custody in Dighwara P.S. Case No.201 of 2013.

Keeping in view the nature of accusation and period of custody, let the petitioner Om Prakash Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri Arvind, Judicial Magistrate, 1st Class, Chapra in connection with Bhagwan Bazar P.S. Case No. 143 of 2014 ( G.R. No.4401 of 2014, T.R. No.4364 of 2014).
