Since both the aforesaid anticipatory bail applications arise out of the same F.I.R., as such, both are taken up together and are being disposed of by this common order. Petitioners apprehend their arrest in connection with Chiraiya PS Case No. 412 of 2022 dated 20-09-2022 registered
Patna High Court CR. MISC. No.34565 of 2023(2) dt.30-05-2023 2/3 under Section 420, 467, 468 and 471 of the IPC. As per the F.I.R., after counseling for appointment on the post of Panchayat Teacher, petitioners submitted forged certificates of CTET / BTET.
Learned counsel for the petitioners submits that petitioners have been implicated in this case on the basis of suspicion and they have not been appointed pursuant to the certificates produced by them. He further submits that the allegation against the petitioners is based upon documents and there is no likelihood that the petitioners will abscond or tamper with the evidence if released on bail.
Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that allegation is based upon documentary evidence for which no custodial interrogation of the petitioners may be required and there is no likelihood that the petitioners will abscond or tamper with the evidence, I am inclined to grant anticipatory bail to the petitioners.
Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) each
Patna High Court CR. MISC. No.34565 of 2023(2) dt.30-05-2023 3/3 with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-4, Sikrahana at Dhaka , East Champaran, Motihari in connection with Chiraiya PS Case No. 412 of 2022 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
