JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is absolutely no allegation of overt act against the petitioner nor anything has been recovered from his possession and his name has cropped up in course of investigation on the basis of confessional statement of co-accused Aashish Ranjan Kumar. It has further been submitted, with reference to paragraph 3 of the application that petitioner did not have any criminal case instituted against him before institution of the present case and after institution of

Patna High Court Cr.Misc. No.49793 of 2014 (2) dt.03-03-2015 the present case he has been named in other two cases of similar nature.

Learned counsel for the petitioner has drawn my attention to the orders of this Court dated 26.9.2014 passed in Cr. Misc. No. 37009 of 2014 and Cr. Misc. No. 37535 of 2014 whereby, two accused persons similarly situated are said to have been granted regular bail.

In view of the submissions as above, let petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.R. Singh, learned Judicial Magistrate, Vaishali at Hajipur in Lalganj P.S. case No. 09 of 2014.
