2. The petitioner has prayed for bail in connection with Barhara P.S. Case No. 48 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 103(1) of the Bhartiya Nyaya Sanhita, 2023 and Section 25(1-b)a, 26, 27 and 35 of the Arms Act.
3. The case of the prosecution is that the informant was coming from Bindgaon on a cycle. Behind him there were 9 known persons name of which is given in the F.I.R. and 15-20 unknown persons arrived there being armed with weapon. It is further alleged that Jitendra Singh fired at younger brother of the informant, namely, Dharmendra Rai. The gun shot hit in the
Patna High Court CR. MISC. No.32634 of 2025(2) dt.22-05-2025 2/3 head of Dharmendra Rai due to which he fell down. It is further alleged that on alarms being raised, Sumit Singh was caught with a double barrel gun.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name in not there in the F.I.R. He has been named by the informant in his restatement before the police. It has further been submitted that from perusal of the F.I.R. itself it is clear that the main assailant is Jitendra Singh and the petitioner is only a member of mob. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 20.03.2025.
5. The learned APP for the State has also got no objection to the submissions, however, he has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court
