Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Dehri (M) P.S. Case No. 45 of 2022, lodged under Section 392 of the Indian Penal Code.
As per prosecution case, the robbery of one tractor was alleged to be made and F.I.R. has been filed against unknown.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that nothing incriminating has been recovered from the possession of petitioner and he was not put on T.I.P. He also submits that from the order sheet passed by the Additional
Patna High Court CR. MISC. No.34527 of 2022(2) dt.04-11-2022 2/2 Sessions Judge-VIIIth, Rohtas at Sasaram it appears that the looted tractor was recovered from one Naga Paswan who was arrested, and on the confessional statement of Naga Paswan the name of petitioner has figured. Learned counsel for the petitioner further submits that petitioner is in custody since 14.03.2022, charge sheet has already been filed in this case and antecedent of petitioner is clean.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Dehri (Rohtas) in connection with Dehri (M) P.S. Case No. 45 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
