The petitioner seeks bail in a case for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 414 of the Indian Penal Code. The allegation against the petitioner is that he was apprehended with a loaded country made pistol and a mobile phone.

It is submitted that the petitioner has been in custody since 16.7.2014. The mobile phone is not stolen article rather it belongs to the petitioner.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist class, Araria, in Raniganj P. S. case no. 122 of 2014 with the following conditions :

1. One of the bailors will be the close relative

2. The petitioner will not indulge in similar or in any other offence.

The petitioner will be well represented in the court.
