The petitioner seeks bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. It is submitted at the Bar by the learned Additional Public Prosecutor that all the witnesses have been examined except the I.O. and the Doctor who are likely to be examined very soon.
Considering the facts aforesaid, the prayer for bail of the petitioner in connection with Sessions Trial No. 127 of 2012 arising out of Barahiya P.S. Case no. 45 of 2002 pending in the court of the learned 2nd Additional Sessions Judge, Lakhisarai is rejected with a direction to the learned trial court to conclude
Patna High Court Cr.Misc. No.50339 of 2014 (7) dt.24-08-2015 the trial of the petitioner within two months from the date of receipt/production of a copy of this order holding the trial on day to day basis.
The Superintendent of Police, Lakhisarai is directed to ensure that the Doctor and the I.O. must be present in the trial court for their evidence on the date fixed in the trial so that the trial must be concluded within the time aforesaid. Let a copy of this order be communicated to the trial court as well as the Superintendent of Police, Lakhisarai for information and needful.
