JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 10.08.2015 in a complaint case filed with accusation under Sections 323, 379, 498A and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act wherein process has been directed to be issued after cognizance being taken.
The basic accusation is of torture for non-fulfillment of the dowry demand.
It appears that the petitioner was granted provisional anticipatory bail by this Court but subsequently the petitioner failed to appear as a result his provisional bail was cancelled and subsequently he surrenders on 10.08.2015.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.2781 of 2016 (2) dt.19-01-2016 2/2 investigation has already concluded.
Considering the fact that investigation has already concluded and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Siwan in connection with Complaint Case No. 1308 of 2011.
