Heard both sides.
The petitioner apprehends his arrest in a case under section 302/34 I.P.C.
The informant made allegation and suspected that the petitioner and other co-accused persons have killed her husband. It is submitted that except suspicion, there is no materials on record but from perusal of record, it appears that the petitioner was found fleeing away from near the dead body and he has got criminal antecedent as he is accused in a case registered under section 302 IPC. Considering the facts and nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly, the same is rejected.
The petitioner is directed to surrender in the court below and the court below shall consider the prayer for regular bail of the petitioner taking into consideration that the co-accused Jattan Yadav @ Ram Jatan Yadav has already been granted regular bail.
