JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 16.04.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

On recovery of an unidentified deadbody, the FIR was lodged against unknown, subsequently, the dead body was identified by one Dhanwanti Devi as her husband who suspected that her husband has been killed by co-accused Motu Mia, Bilai Mia, Shambhu Paswan and others since her husband did not return the loan amount of accused persons. Shambhu Paswan confessed his guilt and also named this petitioner.

It is submitted by learned counsel for the petitioner that Shambhu Paswan has been granted regular bail by this Court vide Cr. Misc. No. 19618 of 2012. A statement has been made in para 3

Patna High Court Cr.Misc. No.11113 of 2015 (2) dt.24-03-2015 2/2 of the petition that the petitioner has no criminal antecedent. Considering the fact that except confession, no material has been collected against the petitioner and the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masauri, Patna in connection with Bhagwanganj P.S. Case No. 46 of 2011.
