The petitioners are languishing in custody since 05.01.2015 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. It is alleged that the informant came to know at 4.00 P.M. on 09.12.2014 that the agnates of his cousin sister had killed her on 08.12.2014 at 8.00 P.M. by putting her on fire and disposed of the dead body.
It is submitted by learned counsel for the petitioners that admittedly the informant was not present at the place of occurrence, name of the person who informed the
Patna High Court Cr.Misc. No.12147 of 2015 (02) dt.30-03-2015 2/2 informant about the occurrence has not been disclosed. Moreover, none of the family members, who were present in the house, have informed the police about the occurrence and the petitioners have been roped in the present case due to the enmity between the petitioners and the victim's family.
A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Taraiya P.S. Case No. 178 of 2014.
