Petitioner is apprehending his arrest in connection with Town Hajipur P.S.Case No.626 of 2018 , registered for offences punishable under Sections 498A, 307/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be mother-in-law is that she sprinkled k-oil and husband of the informant tired to set her on fire but anyhow she escaped. Submission of the learned counsel for the petitioner is that she is mother-in-law and she has been falsely implicated in this case and further more the injury report clearly shows that she had injury of hard and blunt substance and that falsify

Patna High Court CR. MISC. No.31209 of 2019(3) dt.14-08-2019 2/2 the allegation of sprinkling of k-oil on the informant by the petitioner. It has also been submitted on behalf of the petitioner that the divorce decree has already been passed in favour of the informant.

Heard learned A.P.P. and the learned counsel for the informant, who has admitted that the divorce decree has been passed in favour of the informant . .

Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed, the provisional bail granted to the petitioner vide order dated 15.5.2019 is confirmed.
