The petitioner is languishing in custody since 15.02.2015 in a case registered for the offences punishable under Sections 341, 323, 325, 307 and 504/34 of the Indian Penal Code. The accusation against the petitioner is of assaulting Vidyanand Rai with lathi causing fracture of forearm. It is submitted by learned counsel for the petitioner that with regard to passage dispute the accusation has been levelled and there is no accusation of repeating the blow. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and now the investigation has concluded.
