Heard learned counsel for the petitioners and the State.

The petitioners pray for grant of anticipatory bail in Narari Kala Khurd P.S. Case No. 23/2021 registered for the offence punishable under Sections 341/323/307/504/302 of the Indian Penal Code.

The petitioners are said to be the members of the unlawful assembly who assaulted Kusum Devi and four more

Patna High Court CR. MISC. No.43796 of 2021(2) dt.10-02-2022 2/2 persons sustained injuries.

In these circumstances, when the deceased and injured were assaulted by the accused persons including these petitioners, this is not a fit case for grant of anticipatory bail. It is, accordingly, dismissed.

The regular bail of the petitioners shall be considered without being prejudiced by the fact that their anticipatory bail application has been dismissed by this Court. The court below shall consider the fact that similarly situated co-accused has been granted regular bail and also the fact that the deceased had sustained only one injury.
