2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 669 of 2023 dated 13.11.2023 registered for the offence/s punishable u/ss 302, 201 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the informant's Natini went to bring banana leaf but she did not return. On search, the informant found her Natini lying in the ditch of water, thereafter she was taken to hospital where she was declared dead.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the

Patna High Court CR. MISC. No.37866 of 2024(4) dt.01-10-2024 2/2 petitioner has sprung up during the course of the investigation. There is nothing against the petitioner except suspicion. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.12.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. It is further stated that the petitioner killed the informant's Natini for the banana leaf. It is further stated that the said banana tree belongs to the petitioner due to that the petitioner committed murder of her Natini. It is further stated that the tower location of the petitioner was found near the place of occurrence.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail petition of the petitioner stands rejected.

7. Learned trial court is directed to expedite the trial and conclude the same at the earliest.
