The petitioners seek bail in anticipation of their arrest in connection with Sasaram (Darigaon) P. S. Case No. 158 of 2019, dated 26.02.2019, instituted for the offences under Sections 341, 323, 504, 506, 447 and 307 of the Indian Penal Code and Sections 25(1-B)a and 26 of the Arms Act, 1959.
The petitioner no. 1 is the sister-in-law of the
Patna High Court CR. MISC. No.32666 of 2020(2) dt.20-02-2021 2/3 informant whereas the petitioner nos. 2 and 3 are the nephew of the informant.
The accusation in the F.I.R. is of the husband of the petitioner no. 1 having entered the house of the informant with a rifle which was later snatched away by the informant. However, the further allegation in the F.I.R. is that the informant was assaulted by the butt of the rifle as a result of which he has received injuries. The mother and wife of the informant also claimed to have been assaulted.
The learned counsel for the petitioners has submitted that the petitioners as well as informant are related to each other and because of some dispute between them, the present case has been lodged. Considering the relationship of the petitioners with the informant and the nature of accusation, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date

No.32666 of 2020(2) dt.20-02-2021 3/3 of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Darigaon) P. S. Case No. 158 of 2019, subject to the conditions as laid down under Section 438
(2) Cr.P.C.
