JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Petitioners are languishing in custody since 31.12.2014 in a case registered for the offences punishable under Sections 385, 387 of the I.P.C.
It is alleged that extortion demand of rupees five lacs was made and in case of non-payment, threatening was given to kill the grand son of the informant. One of the two mobiles from which the call was made, was registered in the name of the petitioner Jitendra Mahto.

No.13080 of 2015 (2) dt.03-04-2015 2/2 It is submitted by learned counsel for the petitioner Jitendra Mahto that informant was known to the petitioner and the first call was made by the informant to the petitioner Jitendra Mahto and there is nothing on record to suggest the actual conversation made on the relevant date. It is submitted by learned counsel for the petitioner Rajesh Kumar that two mobiles from which extortion demand was made are registered in the name of Malvogi Devi and the petitioner Jitendra Mahto. It is alleged against this petitioner that this petitioner supplied telephone number of the informant to the accused persons.
The statements have been made in para 3 of both the petitions that petitioners have no criminal antecedent. Considering the nature of accusation, investigation being already concluded and both the petitioners having no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 749 of 2014.
