The petitioner seeks bail in a case under Section 394, 302, 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this court vide order dated 04.05.2015 passed in Cr. Misc. No. 6176 of 2015.

It is submitted that the Chowkidar and other witnesses have stated that the deceased was carrying white bag which was snatched by the accused persons but from the possession of the petitioner black bag was recovered which is said to have been identified by the wife of the deceased. It appears that from the possession of the petitioner a

Patna High Court Cr.Misc. No.2597 of 2016 (2) dt.22-06-2016 2/2 black bag containing money, arms and ammunition was recovered, which was duly identified by the wife of deceased, who disclosed that her husband was carrying money in the aforesaid bag. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The learned trial court is directed to expedite the trial and hold the trial on day to day basis so that the trial may be concluded within one year from the receipt/ production of a copy of this order.
