JUSTICE AMARESH KUMAR LAL ORAL ORDER 27-02-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offences punishable under Sections 379 of the I.P.C.

The case was instituted against unknown. During investigation, stolen Bolero vehicle bearing registration No. B. R. 26G/ 9719 has been recovered and the petitioners have confessed their guilt before the police.

It is submitted that the petitioners had hired a vehicle and on way, the police stopped the vehicle and arrested the petitioners and no confession have been made before the police. It is submitted that the petitioners have no criminal antecedents. Considering the facts and circumstances, the above named petitioners, Md. Imteaaz and Md. Shamsher are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Patna High Court Cr.Misc. No.7038 of 2015 (2) dt.27-02-2015 2/2 thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, District- Aurangabad in connection with Obra P. S. Case No. 126/2014 with following conditions :- I) One of the bailors will be the close relative of the petitioners.

II) The petitioners will not indulge in similar or in any other offence.

III) The petitioners will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
