The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Sections 63, 65 of the Copyright Act.
It is a case of recovery of fake Havells wire from the shops of petitioner and co-accused person. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and he has falsely been implicated in the present case. It is also submitted that seized articles has not been compared/tested with the
Patna High Court CR. MISC. No.34855 of 2022(2) dt.28-11-2022 2/2 original articles to prove the allegations of infringement of copyright and petitioner has been made accused without any rhyme and reasons. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 197 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
