The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and under section 27 of the Arms Act.

The prosecution case, as lodged by the informant, is that while he was alongwith his daughter and son-in-law, the petitioner alongwith three other persons intercepted and one Ranjit Saw fired on the head of his son-in-law, who succumbed to the injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.02.2019 and has got no criminal antecedent. There is no specific allegation against the

Patna High Court CR. MISC. No.31290 of 2019(3) dt.05-07-2019 2/2 petitioner and another co-accused Krishna Saw has been granted bail by the Coordinate Bench of this Hon'ble Court in Cr. Misc. No. 63339 of 2017 dated 12.02.2018. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rampur P.S. Case No. 267 of 2017 to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
