Mr.Bharat Lal (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-01-2021 Heard learned counsel for the parties.
This application for grant of regular bail arises out of Mansi P.S. Case No.251 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504,506 of the Indian Penal Code and Section 27 of the Arms Act.
There is direct allegation against the petitioner of having opened fire, which allegedly caused firearm injury to the informant. It appears from the petition itself that the petitioner has criminal antecedent inasmuch as he is involved in another case registered for the offence punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act. Considering the fact that there is direct allegation
Patna High Court CR. MISC. No.33185 of 2020(3) dt.18-01-2021 2/2 against the petitioner and he has criminal antecedent, I am not inclined to grant the petitioner, privilege of regular bail for the present.
This application is accordingly dismissed.
The petitioner shall however be at liberty to renew his prayer for bail after six months, if in the meanwhile, there is no substantial progress at the trial.
