JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Taking into consideration that trial of the petitioner is in full swing and only one witness, namely Ashok Kumar, member of Medical Board and the I.O. have been left to be examined, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Ballia P.S. Case No. 74 of 2014 pending in the court of learned Additional Sessions Judge-Ist-cumSpecial Judge, Posco Act, Begusarai stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months

Patna High Court Cr.Misc. No.13780 of 2015 (3) dt.03-07-2015 2/2 from the date of receipt/production of copy of the order, even by taking the trial of the petitioner on day-to-day basis.

However, it is made clear that if, the trial of the petitioner is not concluded within the above-said period of six months, the petitioner may renew his prayer for bail in the court below itself.
