The petitioner is accused in connection with Navinagar P.S. Case No. 116 of 2015, registered under Section 302/34 of the Indian Penal Code.

The accusation is of killing of the daughter of the informant, namely, Rina Devi by her husband and in-laws due to none providing money to construct the house.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the occurrence is said to be occurred on 10.04.2015, but the complaint petition has been filed on 24.07.2015 after more than three months. Further submission is that, in fact, deceased Rina

No.2082 of 2016 (3) dt.09-03-2016 2/2 Devi, wife of the petitioner, died due to illness and on 10.04.2015 information was given to the informant on which the husband of the informant came and participated in the last ceremony of the deceased, but due to ulterior motive, informant lodged the complaint case no. 575 of 2015 in the Court of Chief Judicial Magistrate, Aurangabad, which is the basis of the present case. Further submission is that petitioner is in custody since 14.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Navinagar P.S.
