The petitioner seeks bail in connection with Warishaliganj P.S. Case No. 163 of 2013 registered for the offence punishable under Section 302/34 of the Indian Penal Code. Allegedly, the petitioner wants to renew the prayer of bail, which has already been rejected by order dated 26.05.2014 vide Cr. Misc. No. 17069 of 2014 as up till now charge has also not been framed and the case has been fixed on 29.01.2015 for framing of charge.
As charge-sheet has already been submitted and the case is pending for framing of charge and as such, the petitioner is directed to be released on bail on execution of bail bond of Rs.
Patna High Court Cr.Misc. No.205 of 2015 (3) dt.28-01-2015 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Warishaliganj P.S. Case No. 163 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
