According to the prosecution case itself, it were co-accused Jeshan and Prince who gave dagger blow to the informant and so far as the petitioner is concerned, it is alleged that he instigated the aforesaid co-accused and when having sustained injury informant raised alarm, petitioner put his hand on the mouth of the informant and got fell him down.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Town P.S.
