Petitioner seeks bail in Kargahar P.S. Case No.259 of 2018 registered under Sections 20(b)(ii)(c), 21, 25 and 29 of the N.D.P.S. Act.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was twice rejected vide order dated 06.12.2018 and 20.11.2019 passed in Cr.Misc.No.64700 of 2018 and Cr.Misc.No.52895 of 2019 respectively but the trial has not yet been concluded. On such, a report was called for. The report of learned District & Sessions Judge, Rohtas at Sasaram shows that the trial has already been concluded. The statements of the accused have also been recorded under Section 313 of the Cr.P.C. and the argument is going on. Taking into consideration the fact that the trial is at
Patna High Court CR. MISC. No.33314 of 2020(4) dt.27-01-2021 2/2 the fag end and the argument is being heard, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
