The petitioner apprehends his arrest in a case registered for the offence under Sections 406/420 of the Indian Penal Code.

As per the prosecution case, this petitioner in collusion with the owner of the truck sold the scrap wastage material of the informant and thus cheated him. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. The petitioner is the owner of the transport company and there is no chit of paper to show that the aforesaid consignment was loaded in truck in question. Petitioner has no criminal antecedent.

No.34442 of 2022(2) dt.20-10-2022 2/2 However, learned counsel for the informant vehemently opposes the prayer for bail and submits that there is specific allegation against this petitioner that he in collusion with driver of the truck sold the scrap wastage material of the informant.

Considering the nature of acquisition and the materials available on record, the prayer for anticipatory bail of the petitioner is rejected.
