The petitioner is languishing in custody since 19.01.2015 in a case registered for the offences punishable under Sections 467, 468, 471, 472, 420, 414 and 401/34 of the Indian Penal Code.

On information of CID that in the rented house of Surya Narayan Yadav miscreants are operating a gang of motorcycle lifter, raid was laid, when Mithilesh, Nitish, Saroj and Nawal were apprehended and from their possession motorcycle and mobile were recovered. On the confession of Mithilesh motorcycle was also recovered from the shop of the petitioner. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.12124 of 2015 (02) dt.30-03-2015 2/2 petitioner that the petitioner runs a motorcycle repairing shop and admittedly the motorcycle was given for repair by co-accused Mithilesh.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani in connection with Babubarhi P.S. Case No. 02 of 2015.

Since petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions. (Dinesh Kumar Singh, J) DKS/- U T
