Petitioner seeks bail in Piri Bazar P.S. Case No.54 of 2020 registered under Sections 363 and 366(A) of the IPC. The informant (father of the victim) alleged that two days before the lock-down, the petitioner fled away with his daughter, who is studying in Intermediate, for the purpose of marriage. On 08.05.2020, the petitioner and the victim came and on such, an information was given to the informant. Learned counsel for the petitioner submits that the petitioner was having love affairs with the victim. The victim also made statement under Section 164 of the Cr.P.C. and she disclosed that she solemnized marriage with the petitioner and she is pregnant but the petitioner on account of undue pressure
Patna High Court CR. MISC. No.33352 of 2020(3) dt.11-01-2021 2/2 given by his parents does not want to keep his wife (victim). The victim further disclosed that she was also assaulted. It is submitted that now the compromise has been filed. The victim is still living with the petitioner. She gave birth to a child. Taking into consideration the facts aforesaid and the fact that the petitioner is in jail since 10.05.2020, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No.54 of 2020.
