The petitioner apprehends his arrest in Teghra P.S. Case no. 233 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The father of the deceased named the petitioner and other accused persons but the informant is not an eye-witness of the occurrence. The informant only claimed that his son was killed by Gautam Paswan, Pankaj Paswan, Ghanshyam Paswan, Bimal Kishore Singh and Shukul Singh (the petitioner).

During course of the investigation, Ginni Devi, the second wife of the deceased disclosed that the petitioner killed her husband Narayan Singh but she made her statement after 19 days of the

It is submitted that she is not an eye-witness of the occurrence. Similarly, Rani Devi made her statement after more than one month and she was also not present at the place of occurrence. From perusal of record, it appears that on suspicion the name of the petitioner has come only because the deceased had illicit relation with Ginni Devi, the daughter of Ram Ekbal Singh and Bimal Kishore Singh happens to be the relative of Ram Ekbal Singh. The petitioner is said to be the friend of Bimal Kishore Singh who wanted to grab the land of Ram Ekbal Singh.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S.
