JUSTICE SATYAVRAT VERMA ORAL ORDER 05-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks regular bail in connection with Special Case No. N.D.P.S.-4 of 2021 arising out of Amarpur P.S. Case No. 315 of 2021 dated 26.06.2021 instituted for the offences under Sections 8, 20(b)(ii)(A) of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 26.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 4.72 grams of ganja filled in six cigarettes.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.06.2021, charge-sheet has been submitted in the case, the petitioner is a person with clean antecedent and allegation is of recovery of 4.72 grams of ganja which is much less than the small quantity, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Banka in connection with Special Case No. 4 of 2021 arising out of Amarpur P.S. Case No. 315 of 2021.
