The petitioner is languishing in custody since 14.12.2014 in a case registered for the offences punishable under Sections 341, 323, 324, 504, 379/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act, but subsequently charge-sheet has been submitted under Section 307 of the IPC also.
It is alleged that the accused persons abused the informant by calling caste name and on the protest being made they assaulted the informant with fists and slaps. On the alarm of the informant his landlord came to his rescue when this petitioner assaulted him with Khanti and co-accused assaulted with Spear.
Patna High Court Cr.Misc. No.10737 of 2015 (02) dt.24-03-2015 2/2 One of the injuries of the landlord of the informant has been found to be grievous.
It is submitted by learned counsel for the petitioner that there is a counter version of the occurrence also and the informant has entered into compromise.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 289 of 2014.
